undefinedWhat Is a DMV NOTS Hearing?

The CA DMV is tasked with maintaining all CA drivers' motor vehicle driving records (MVR) and tracking the negligent operator treatment system (NOTS) points assessed for traffic convictions and at-fault accidents. 

When a CA driver accumulates four or more NOTS points in one year, six or more in two years, or eight or more in three years, the DMV will mail the driver an Order of Suspension/Revocation and Probation.

However, the driver can request a DMV NOTS hearing to present evidence of mitigation or remove inaccurate information from their MVR.

The request for a DMV NOTS hearing must be made within ten days of notification by telephone or written request. DO NOT delay.

Although a driver is not required to hire a CA traffic attorney to review their MVR and represent them at a DMV NOTS hearing, who better to assist them than a traffic attorney who spends most of their working career in traffic court listening to similar cases to those that they need to be removed from the record?

What is NOTS?

The DMV is authorized by the CA Assembly and the Governor to monitor and execute NOTS by authority of CA Vehicle Code (VC) Section 12810Issuance and Renewal of Licenses. 

This traffic code defines which convictions of traffic code require an assessment of two NOTS points, such as major infractions, misdemeanors, and felonies, and which are one-point violations, such as minor infractions and at-fault accidents in which the driver was greater than zero percent responsible. 

One-point infractions and accidents are maintained in the individual’s MVR for three years unless sooner adjudicated or successfully appealed. 

Major infractions are kept in the MVR for up to seven years, and misdemeanors and felonies for seven to ten years. 

A knowledgeable and experienced traffic attorney could request the removal of convictions and paid fines for convictions that have been successfully appealed or when the traffic code has changed or was incorrectly applied.
