When you face a 100+ speeding ticket, you must hire a traffic attorney with a reputation for fighting and winning those charges. Make no mistake; you cannot afford not to fight a charge that has the potential of costing you $900 to $2,500 initially and very possibly $10,000 iin increased insurance premiums over the next seven years.
What’s more, you have a mandatory court appearance in the county where you received the citation, so hiring a local lawyer to challenge your ticket will save you from taking time off from school or work. Once you hand it over to an experienced and knowledgeable traffic attorney, you can forget about it and go on with your life.
To get peace of mind during this potential crisis, you need a law firm that has written a book about defending a 100+ speeding ticket. That is the Bakersfield Traffic team of Bigger & Harman, APC. If you’d like a copy of that book, 4 Unknown Consequences of Driving over 100 MPH, email the office of Bigger & Harman, attorney@biggerharmanlaw.com.
What the CA Traffic Code Says about 100+ Speeding Tickets
For those of you who like to Google the legislative info about the law you have been accused of violating, it’s CA Vehicle Code (CVC) Section 22348, Speed Laws. You can skip a step and just click the highlighted text.
There you will see paragraph (b) says that anyone who drives on the “…highway at a speed greater than 100 miles per hour is guilty of an infraction…” and it further states a first-time conviction will cost “…a fine of not to exceed five hundred dollars ($500).”
You might ask yourself why we say $900 to $2,500 if it’s only $500. Typically, a traffic court judge will fine you between $300 and $500. However, that figure is the “base fine.” Since the original traffic code for a 100+ speeding ticket was written and approved by the governor, ten separate penalties, fees, and assessments were added by the CA legislature and approved by the governor.
These fees and funds are added to the base fine as shown:
Therefore, as you can see a base fine of $300-$500 will actually cost the convicted driver $1,270 to $2,030 depending on the county of conviction. Each county has the latitude to charge you up to the full amount of those penalties and assessments.
However, the most significant penalty is the two negligent operator treatment system (NOTS) points the DMV will assess if convicted. These two NOTS points will cause your auto insurance company to double or triple your premium if they decide to retain you as a client. So, you can figure if you’re currently paying $2,000 per year, you could wind up paying $4,000 to $6,000 per year for seven years.
Plus, that is only for the average driver. If you have a teen on your policy or you are a teenage driver, you can count on paying much, much more.
By the way, the traffic court judge has the discretion to suspend your driving privileges for 30 days, automatically, and you are only two NOTS points away from a six-month suspension and 12-month probation.
Therefore, contact a CA licensed traffic attorney for peace of mind to assist you in fighting your 100+ speeding ticket.
