When you receive a traffic ticket and want to challenge it, you might wonder how to get the results you want from Bakersfield Traffic Court. The answer is to choose the traffic ticket defense team of Bigger & Harman.
Bigger & Harman only take traffic law cases. What does that mean to you? “In a nutshell,” to coin a much-used cliché, practicing only one type of law allows them to master their craft. Do you know why most editors and critics advise against using clichés in writing? It’s because of the familiarity. People are familiar with the cliché because they hear it so often.
When practicing law, hearing the same thing over and over is an excellent thing that can work in your favor. That is how “precedence” gets developed. Every law has specific elements the state must prove to find you “guilty beyond a reasonable doubt.” We’ve all heard it on TV or when we were on jury duty. If there is a doubt, you must acquit.
Traffic Court Rulings
In traffic court, it is a little bit different because there is no jury and the judge or judicial officer decides guilt or innocence. The judge might also decide to reduce the charges without hearing a dispute based on a request by your attorney. In many cases, a judge will grant the request of an attorney to reduce a ticket or multiple tickets to save the court’s time, and in the interest of justice.
These reductions often come in the form of a “no-point” conviction. This plea deal means you will pay a fine and whatever penalty the court prescribes such as Traffic Violator School (TVS). However, this “deal” can be very beneficial to the driver because even though they have to pay the fine, their insurance will not go up.
Keep in mind, the average Californian pays $1960.00 annually for auto insurance. Just one conviction with points can mean your insurance company pulls your “good driver’s discount,” and adds the risk associated with the conviction, which will raise your premium by about $500.00 a year or more.
Getting What You Need with a Traffic Court Attorney
When you look at how much it could cost you to pay a fine without contesting it, you will realize it’s a mistake. You must consult an attorney who regularly practices in traffic court. The fine is just the “tip of the iceberg.” Once you pay the fine, that part is over.
However, an increase in auto insurance will remain until the conviction is removed from your driving record. That’s three years for a minor infraction, seven for a major infraction, and ten years for misdemeanors and felonies. And, the criminal record will remain with you for life. Once again, always consult an attorney.
